These Terms of Service ("Terms") govern your access to and use of shopthundergrip.com, including all information, content, features, customer communications, and purchases made through the website (collectively, the "Services").
The Services are operated by Gordura Commerce L.L.C., doing business as Thunder Grip ("Thunder Grip," "we," "us," or "our"). By visiting the website, placing an order, or otherwise using the Services, you agree to these Terms and to the policies referenced in them.
Please read these Terms before using the Services. If you do not agree, do not use the Services or place an order.
1. Eligibility and Authority
You must be at least the age of majority in your place of residence, or use the Services with the involvement and permission of a parent or legal guardian. If you use the Services for a business or other organization, you represent that you have authority to bind that organization to these Terms.
2. Our Online Store and Shopify
Our online store is hosted by Shopify. Shopify provides the commerce platform that allows us to display products, process orders, and provide checkout and related functions. Your use of certain Shopify-enabled features may also be subject to Shopify's applicable terms and privacy notices.
3. Products and Product Information
Thunder Grip sells rubber stair treads and related stair-safety and home-improvement products. We make reasonable efforts to describe and display products accurately. However, colors, textures, dimensions, weights, patterns, and packaging may vary slightly because of manufacturing tolerances, materials, device displays, or product updates.
Product photographs, descriptions, compatibility statements, measurements, and installation guidance are provided for general information. Before ordering, you are responsible for checking dimensions, intended use, surface type, placement, and any other requirement relevant to your stairs or project.
We may change product specifications, packaging, availability, or assortment without notice, provided that changes do not materially reduce the features of an order already accepted unless we offer an appropriate remedy.
4. Stair-Safety and Installation Notice
No stair tread, mat, adhesive, or surface can make stairs completely slip-proof or eliminate the risk of falls or injury.
Thunder Grip products are designed to help improve traction when correctly selected, placed, installed, inspected, cleaned, and maintained. They are not a substitute for repairing unsafe, damaged, uneven, structurally unsound, or non-compliant stairs.
Read and follow all product-specific instructions and warnings before use.
Place products only on clean, sound, suitably flat surfaces and confirm that each tread lies flat, remains stable, and does not create a raised edge or trip hazard.
Depending on the surface, traffic, wind, weather, slope, or other conditions, suitable adhesive, mechanical fasteners, or professional installation may be necessary. Unless expressly included in the product description, installation materials are not included.
Inspect the stairs and treads regularly and before use. Reposition, secure, repair, or replace any tread that moves, curls, cracks, tears, becomes excessively worn, or no longer lies flat.
Remove snow, ice, mud, leaves, oil, water buildup, and other contaminants. Wetness, frost, ice, debris, chemicals, and wear can reduce traction.
Use appropriate care when cutting or modifying a tread. Follow tool-safety instructions and verify that modified edges remain flat and secure.
Do not rely on the product as structural reinforcement, as a repair for damaged stairs, or as proof of compliance with building, accessibility, workplace, landlord, insurance, or other requirements.
You are responsible for evaluating your specific site and use conditions. Consult a qualified contractor or other professional when you are unsure about surface condition, installation method, code compliance, or suitability.
5. Orders and Acceptance
Your order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean that we have accepted the order. We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or listing errors, shipping restrictions, or violation of these Terms.
If we cancel an order after payment has been captured, we will refund the amount charged for the canceled portion using the original payment method, subject to payment-provider processing times.
You agree to provide current, complete, and accurate billing, shipping, contact, and payment information. You are responsible for reviewing your order before submitting it.
6. Prices, Discounts, Taxes, and Payment
Prices and promotions are shown in the currency displayed at checkout and may change without notice before an order is placed. Discounts, coupon codes, free-shipping thresholds, and promotions may be subject to separate conditions, expiration dates, exclusions, and minimum-purchase requirements. Unless expressly stated, offers cannot be combined.
Applicable taxes, shipping charges, duties, and other charges are shown or calculated where reasonably possible. For international orders, the recipient may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by the destination country.
You authorize us and our payment processors to charge the payment method you select for the total shown at checkout. We do not generally store complete payment-card details; payment information is processed by Shopify and applicable payment providers.
7. Shipping and Delivery
Shipping methods, timeframes, costs, and any geographic restrictions are shown on our product pages and at checkout before you complete your order.
Delivery dates are estimates unless we expressly agree otherwise. Delays may occur because of carriers, weather, customs, address issues, peak demand, or events outside our reasonable control.
You are responsible for providing a complete and accurate delivery address and for ensuring that delivery can be safely completed. Please inspect the package promptly and contact us if an item is missing, incorrect, or appears damaged in transit.
8. Returns, Refunds, and Exchanges
Eligibility, deadlines, condition requirements, exclusions, and procedures for returns, refunds, and exchanges are described in our Return Policy. A return based on change of mind, fit, color, or other non-defect reason, and any claim involving an alleged manufacturing defect, are handled in accordance with the Return Policy.
9. Accounts
If customer accounts are available, you are responsible for maintaining the confidentiality of your login credentials and for activity under your account. Notify us promptly if you believe your account has been accessed without authorization.
We may suspend or terminate an account when reasonably necessary to protect customers, prevent fraud or abuse, comply with law, or enforce these Terms.
10. Reviews and Other User Content
You may be able to submit reviews, ratings, photographs, videos, comments, questions, or other content ("User Content"). You retain ownership of your User Content.
By submitting User Content to us or through the Services, you grant Thunder Grip a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, modify for formatting, publish, display, distribute, and use that User Content in connection with operating, improving, and marketing Thunder Grip and its products, subject to applicable privacy and advertising laws.
You represent that you have the necessary rights to submit the User Content and that it is accurate to the best of your knowledge, reflects your honest experience or opinion, and does not violate law, intellectual-property rights, privacy rights, or the rights of another person.
We may moderate or remove User Content that violates these Terms, is unlawful, deceptive, abusive, irrelevant, contains personal information, or creates security or operational risk. We are not required to publish every submission.
11. Prohibited Uses
You may not use the Services to:
Violate any applicable law or the rights of another person.
Commit fraud, submit false information, interfere with payment processing, or misuse discounts or promotions.
Upload malware, malicious code, or content intended to disrupt or compromise the Services.
Scrape, crawl, copy, reverse engineer, or access the Services through automated means except as permitted by law or by our written authorization.
Impersonate another person, misrepresent your affiliation, or attempt to gain unauthorized access to an account or system.
Submit unlawful, infringing, deceptive, defamatory, harassing, or otherwise harmful content.
Use the Services or product information to create a competing database or commercial service without our permission.
12. Intellectual Property
The Services and their content, including product names, trademarks, logos, text, photographs, graphics, videos, page design, and software, are owned by or licensed to Thunder Grip and are protected by intellectual-property laws. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Services for lawful shopping and informational purposes.
Nothing in these Terms transfers ownership of Thunder Grip intellectual property. You may not use Thunder Grip names, trademarks, logos, photographs, or other protected content without prior written permission, except as allowed by law.
13. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, payment providers, carriers, social-media platforms, applications, or services. We do not control third-party services and are not responsible for their content, availability, security, or practices. Your use of a third-party service is governed by that third party's terms and policies.
14. Privacy
Our collection and processing of personal information are described in our Privacy Policy.
15. Website Availability and Disclaimer
We seek to keep the Services accurate, secure, and available, but interruptions, errors, delays, or technical issues may occur. To the maximum extent permitted by law, the website and its non-product informational content are provided on an "as available" basis.
We do not disclaim or limit any warranty or consumer right that cannot lawfully be disclaimed or limited under applicable law.
16. Limitation of Liability
To the maximum extent permitted by law, Thunder Grip and its officers, members, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from the Services or a product.
To the maximum extent permitted by law, our aggregate liability arising from a particular product purchase will not exceed the amount you paid for that product, except where a greater remedy is required by applicable law.
These limitations do not apply to liability that cannot lawfully be limited or excluded, including, where applicable, liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or injury caused by a defective product.
Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the limitations apply only to the extent permitted by law.
17. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Thunder Grip and its affiliates, personnel, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your material violation of these Terms, or User Content that infringes another person's rights. This section does not require a consumer to indemnify us for our own negligence, wrongdoing, defective products, or breach of law.
18. Electronic Communications
You agree that order confirmations, notices, policies, disclosures, and other communications may be provided electronically, including by email or through the Services. Electronic communications satisfy any legal requirement that communications be in writing, to the extent permitted by law.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles, except that mandatory consumer-protection laws of your place of residence continue to apply where they cannot be waived.
Before filing a legal claim, we encourage you to contact us so we can attempt to resolve the matter in good faith. This informal step is voluntary and does not reduce or delay any non-waivable right or limitation period.
Subject to applicable consumer rights regarding venue and jurisdiction, disputes that cannot be resolved informally may be brought in the state or federal courts with jurisdiction in or serving Sheridan County, Wyoming. You may also bring an eligible claim in small-claims court or another forum required by applicable law.
20. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on the Services with a revised "Last updated" date. Changes apply prospectively unless applicable law requires otherwise. Your continued use of the Services after the effective date of updated Terms constitutes acceptance of those Terms, to the extent permitted by law.
21. General Provisions
If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted and the remaining provisions will remain in effect.
Our failure to enforce a provision is not a waiver. These Terms, together with the policies incorporated by reference and any product-specific terms presented at purchase, constitute the agreement between you and Thunder Grip regarding the Services and your purchase.
You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, reorganization, financing, sale of assets, or similar transaction, subject to applicable law.
